General Terms and Conditions

General

  1. These General Terms and Conditions govern the business relationships and procedures in connection with the services offered by yourmile AG.
  2. yourmile AG acts as an intermediary between passengers (clients) and transport providers. It provides the administrative, personnel and technical services required for this purpose without itself providing transport services.
  3. The legal transport contract is therefore concluded between the customer and the transport partner.
  4. Within the scope of its possibilities, yourmile ensures that its transport partners have all official licences and provide a safe service.
  5. yourmile endeavours to provide its services on a permanent basis and to remedy any disruptions immediately. However, no right to uninterrupted availability can be derived from this.

Orders and payment

  1. By placing an order with yourmile, the client accepts the agreed conditions under which he or she will be transported by the partner company.
  2. The transport charge is either agreed in advance at a flat rate or calculated by means of a taximeter in the vehicle. In the latter case, the fare displayed at the end of the journey shall be deemed to be the fare agreed by the parties.
  3. The charge is due as soon as the price of an order is known in accordance with point 7. From that moment it is due for immediate payment without deductions.
  4. Cash in Swiss francs and the customary credit and debit cards are recognised as means of payment. For app orders, only cashless payments are provided for due to the technical processing.
  5. For larger and/or recurring orders, yourmile reserves the right to payment on account and prior credit checks.
  6. If a client defaults on payment, yourmile is entitled to charge reminder fees and interest on arrears and to suspend the placement of orders until the outstanding debt has been settled in full.

Order cancellation and no-shows

  1. A taxi order can be cancelled free of charge up to 2 hours, all other orders two working days before the appointment. After that, the full amount is owed.
  2. If a client is not at the agreed pick-up location, a no-show fee may be charged.
  3. Taxi drivers are not obliged to wait for late passengers free of charge. Waiting time will be charged at the taxi rate.

Liability

  1. yourmile is liable insofar as the cause of the damage is based on an intentional or grossly negligent breach of duty.
  2. Liability is limited to the booking amount of the respective journey.

Taxicard

  1. yourmile operates its own cashless payment system called Taxicard. This customer card exists in a prepaid and a postpaid format.
  2. Those transport partners who accept Taxicards are listed on the website www.taxicard.ch.
  3. Prepaid cards are topped up in advance via the online shop and entitle the holder to pay for journeys until the balance is used up.
  4. Postpaid cards entitle the holder to pay by monthly invoice after a successful credit check. The cards are in the name of the company or private customer and are non-transferable.
  5. yourmile will invoice the completed journeys with an itemised bill. The invoice must be checked immediately and any discrepancies must be reported in writing within 10 days. The invoice is then deemed to have been approved.
  6. In the event of late payment, Art. 11 shall apply. The right is reserved to block the card without prior notice.
  7. The customer is responsible for the proper use of the Taxicard and is liable for any damage resulting from misuse, loss, theft or damage, etc. The customer is also responsible for the correct use of the Taxicard.
  8. In the event of loss or theft, yourmile must be informed immediately so that the customer card can be blocked. Yourmile may charge a handling fee for the production of replacement cards.

Data protection

  1. Personal data is only processed and passed on to transport partners to the extent necessary for order processing.
  2. yourmile stores and manages customer data in domestic data centres under Swiss data protection legislation.
  3. For anonymised online analysis, yourmile is entitled to use external services (e.g. Google Analytics, or similar).

Adjustments, place of jurisdiction

  1. These terms and conditions come into force on 1 August 2023 and replace all previous GTC.
  2. Swiss law applies, place of jurisdiction is Kloten ZH.
